英文摘要	郑毅，中央民族大学法学院副教授，法学博士。; 【中文摘要】在农村土地集体所有、农村建设用地国有化征收、政府的主导和垄断地位等既有制度无法突破的前提下，农民权利保障的关键在于两个层面的公众参与模式的贯彻落实：一是决定与实施过程中的公众参与；二是基础决策过程的深度公共参与，即农民在土地国有化过程中以更为积极、主动、有效的方式与政府互动，从而实现效益的双赢与最大化。后一方面受到当前法制理论和实践的关注极为有限，而土地增减挂钩政策恰成为该层面公众参与的实践典型。虽然优劣并存，但至少为将来以第二层面的公众参与为核心推动农村建设用地流转制度的推广和完善提供了有益的参照。 【Abstract】Nowadays, as the key of protection of farmers’ rights, there are two gradations of public participation of rural collective land expropriation in the condition such as rural land owned by the collectives, land expropriation by the state, guiding and monopoly of government. One gradation is the participation in the process of implementation; the other is the fundamental participation in decision-making process. The latter, which is badly ignored today, actually enable farmers interact with governments more actively, forwardly, effectively and create win-win situation. Linking increase and decrease is the typical example and it provides a useful reference to the system development and perfection。; 本文系2011年度国家社科基金重点项目“中央与地方事权关系法律问题研究”（11AFX010）的阶段性成果。
