英文摘要桂静,国家海洋信息中心副研究员,硕士。电子邮箱:jingui59167@yahoo.com.cn。; [文摘]近年来,国家管辖以外海域的管理越来越受到国际社会的重视。作为新的管理手段,国家管辖范围以外海洋保护区有其产生的现实基础和法律基础,因此有其存在的积极意义。目前,国际社会对国家管辖范围以外海洋保护区进行了一定程度的规范,但依然存在着诸如没有成形的法律框架、科学研究明显滞后于实践等问题。可以预见,今后国际社会将加强对相关海域的国际法律框架研究、继续加大相关海域生物多样性的科学研究并且更加强调国际合作。[Abstract]In recent years,the management of sea areas beyond national jurisdiction has been drawing more and more attention from the international community.As new management tools,marine protected areas (MPAs) beyond national jurisdiction have both a scientific and legal basis,and therefore their existence is likely to have a positive impact.Currently,the international community regulates marine protected areas beyond the limits of national jurisdiction to a certain extent,but has not yet formed a complete/comprehensive legal framework.What is more,research on MPAs has lagged far behind,making it difficult for policy makers to make informed decisions.In the future,the international community should promote the implementation and improvement of the international legal framework for these MPAs and continue scientific research on marine biodiversity.In addition,international cooperation should also be emphasized to a greater degree.
