| 英文摘要 | 随着高新技术的更新换代，为推动市场统一化步伐、促进市场协调发展、提高消费者福利，标准的制定与推广成为知识经济与技术发展的趋势。标准在规范产品质量、保证产品兼容、推动技术创新等方面所呈现出有益竞争的正效应；与此同时，标准也如同悬在市场竞争头上的达摩克利斯之剑，存在着权利滥用、限制消费者选择、抑制创新等阻碍竞争的负效应。 目前，标准必要专利的许可费多采纳公平、合理、非歧视原则（即FRAND原则），它在平衡各方利益、适用广泛上拥有不可替代的优势。但是，该原则也存在一定的弊端，如“公平、合理”概念模糊、“歧视性价格”与“合理差异”不易区分等，使得有关标准必要专利许可费认定的司法实践存在较大难度，个案...; With the globalization of economy and the rapid development of IPR, the great changes of standardization mode in technical field are taking place.
