英文摘要	非正式法律渊源，究其本质乃是一种法律渊源。从立法视角看，非正式法律渊源是相对于制定法等正式法律渊源而言的其他规范形式；从司法视角看，非正式法律渊源是影响法官裁判规则形成的综合因素。正是这种“双重身份”，注定了其功能定位具有复合性。作为规范，其在司法裁判面临立法空白和疏漏时，发挥漏洞补充及法律续造的功能；作为法官法源，其在司法决策过程中发挥维护裁判正义的功能。而司法适用的本质即法官在司法决策时生成裁判规范的过程，这一过程充满着法官的能动性，法官或有意或无意地从非正式法律渊源中寻找裁判依据，并将其转换为裁判理由。故本文的关注点即在于考察司法过程中，法官是如何将非正式法律渊源转化为裁判理由的。 本...; Informal source of law is essentially belonging to source of law.
