| 英文摘要 | 现代社会是追求法治的社会，法治的核心要义就是必须依法办事，在我国这样一个行政权占据主导地位的国度，强调行政机关依法行政对法治社会的建设具有至关重要的作用。基于对滥用行政权力导致严重后果的历史经验总结和学习世界各国权力运行的先进理念，我国设立了行政诉讼制度保护公民个人权利和监督行政机关依法行政。在行政诉讼中，行政撤销判决是行政判决类型体系中最为重要、运用最为广泛的判决类型,因为原告行政诉讼请求的主要内容就是要求撤销或部分撤销违法具体行政行为，而法院运用审判权撤销违法具体行政行为，就是对行政相对人权利最直接和最有效的保护。然而，现行的撤销判决制度没有从行政法理论基础之上作出规定，而只是采用简单的罗...; The modern society is a rule-of-law society.
