英文摘要	医疗行为从人类远古社会就广泛存在，在这一行为中，医生和患者之间形成了彼此依赖却又相互矛盾的关系。早期的医患关系为医生主导的父权主义模式。晚近以来随着医学技术进步、网络信息爆炸，医患双方的医学知识鸿沟正在逐渐缩小，加上现代先进的医疗器械的加入，医患关系产生了一定的物化现象，病人的权利意识日渐增强，患者的知情同意权逐渐受到关注。但由于我国法律法规的不完善，在实际行使这一权利的过程中出现了不少问题，例如患者知情同意权与医生自由裁量权之间的矛盾，患者近亲属代为行使时的权力滥用。本文对《侵权责任法》第55、56条进行分析，并在参考国外做法经验的基础上提出解决建议。 本文一共分为四章： 第一章对患者知...; Medical practices have widely existed from ancient society.
