| 英文摘要 | 在当今世界诉讼爆炸的背景之下，以诉讼和审判为中心的正式程序要求通过与各种纠纷解决机制的融合，使有限的司法资源得到最有效的利用。在多元化的纠纷解决机制中，诉讼调解制度起到了重要的衔接作用。为了最大限度地发挥诉讼调解制度维护社会和谐、节约司法资源的优势，法院可通过不同的制度安排鼓励当事人在诉讼中选择调解。 对于国家而言，通过一定的制度设计既保障国民获得司法裁判的权利，又对国民滥用诉讼资源的行为予以必要的限制至为重要。而在诉讼调解激励机制的设计中，合理的诉讼费制度安排，显然可以对当事人诉讼行为的选择产生良好的影响。 本文中，笔者通过对英国诉讼调解实践中诉讼费罚则运作情况的研究，考察我国目前的诉讼...; Formal procedure is constructed by litigations and trials.
