英文摘要	随着加入WTO实践的充分展开,尤其是WTO争端解决机构处理涉及《中国入世议定书》争端的深入发展,入世议定书的法律效力问题日益凸显。从条约法理论出发进行分析,入世议定书具有并入及修改《WTO协定》的法律效力,这对理解入世议定书与《WTO协定》的关系提供了一种思路,有助于WTO争端解决机构正确解释和适用入世议定书。在日益受到WTO成员根据《中国入世议定书》发起的挑战的情况下,中国应当在正确理解入世议定书法律效力的前提下,从WTO的立法和司法层面积极寻找对策。; With the unfolding of the practice of accession to the WTO,especially the development by WTO dispute resolution organs of the practice of handling disputes over the Protocol on China's Accession to the WTO,the issue of legal effect of protocols on the accession to the WTO becomes increasingly prominent.An analysis from the treaty law point of view shows that protocols on accession to the WTO have the legal effect of being incorporated into and revising the WTO Agreement.This provides us a new way to understand the relationship between protocols on accession to the WTO and the WTO Agreement,and is conducive to the correct interpretation and application of such protocols by WTO dispute resolution organs.Faced with more and more challenges raised by other WTO members on the basis of the Protocol on China's Accession to the WTO,China should,under the precondition of correctly understanding the legal effect of the Protocol,actively explore countermeasures to such challenges at both legislative and judicial levels.; 教育部2011年度“新世纪优秀人才支持计划”(项目编号:NCET-11-0292)的阶段性研究成果
