中文摘要	科技支持下的"人工固岛",不仅是岛屿所属国与自然博弈的需求,同时也是争取海洋权益最大化的手段,但也可能因此与其他国家或国际社会的利益产生摩擦甚至冲突。在此方面的规则主要见于《联合国海洋法公约》第121条及其反映的习惯国际法,但该规则的模糊性使得有必要探讨"人工固岛"的法律因应。本文旨在从国际法层面分析"人工固岛",为此对其从规则与实践层面予以溯源,从岛屿制度视角加以评判,在海洋划界背景下分析相关处理。本文认为,针对第121条规则的不同解释所导致的迥异适用效果在实践处理中被调和。通过第121条所追求的人工固岛的法律效果,在实体层面受到国际法中稳定、公平、善意等基本原则的约束与限制。但这种约束与限制的实现,有赖于国际共同体各方在程序层面的反应。; Artificial consolidation of islands has become possible thanks to the technological development.As for States owning islands,it not only meets the need of combating with the natural influence,but also serves as a means to maximize maritime rights and interests.Nevertheless,it could also clash and even conflict with the interests of other States and international community.The relevant legal framework is the rather vague rules embodied in the Article 121 of the United Nations Convention on the Law of the Sea as well as relevant general international law,which necessitates the discussion over the legal response to the artificial consolidation of islands.Aiming to explore this issue in international law,this article examines its origin in rules and practices,assesses its implication from the legal regime of islands,and analyzes its treatment in the context of maritime delimitations.It is submitted that the divergent application effects resulting from different interpretations of the Article 121 has been reconciled in the treatment during the practice.The legal effect of artificial consolidation to be achieved through the Article 121 is regulated and restrained by relevant fundamental principles in international law,inter alia,stability,equity and good faith.The materialization of such restraints and regulations,however,requires procedural responses of the concerned parties in the international community.
