中文摘要	美国宪法体现了一般性的宪法原理,但在具体制度和宪法文化上也呈现出了极强的独特性。本文借助宪法民族志的研究方法,从历史、文化和法律的整体视角,勾勒出美国独特宪法文化的外在形态和意义结构。美国成文宪法的至上性、司法审查的重要性以及本土规范的至上性三大特点,源于美国革命所开创的独特历史经历和政治想象。美国民众对于宪法的崇拜因其是美国革命的产物,对于法院和司法审查的信仰因其是弥合代际断裂、构建民族历史共同体的重要机构和机制,对于本民族规范的推崇因其是美国独特历史的产物,而非普遍理性的推论。因而,深入地理解美国宪法不仅仅需要研究《美国宪法》的文本,也不仅仅要求细致地分析最高法院的具体案件的判词,且要深入地理解美国宪法的历史语境,把握支撑其实践运作的潜在逻辑与信仰结构。; While incarnating universal constitutional values,the American constitution also shows its own features in concrete institutions and constitutional culture.Employing the methodology of constitutional ethnography,this article maps out the external forms and structure of the meanings of American constitutional culture.The supremacy of the Constitution,the importance of judicial review,and the triumph of constitutional nationalism flow from the particular,exceptional historical experience begun by the American Revolution.The Constitution is revered because it is a product of the Revolution;judicial review is respected because it helps build the trans-generational,historical,and political community of the American people;indigenous norms hold sway because they grow in the particular historical ground of the American polity.A constitutional ethnography of the United States can help us understand the American constitution as a whole way of life,which includes,but is not limited to,the American Constitution and American constitutional law.
