中文摘要	试图从产权配置的视角,来透视当前旧城更新困境并提供解决思路。首先,反思旧城房屋的公有产权制度,指出产权所有者缺位是旧城大规模更新得以蔓延、历史风貌遭到破坏的内在诱因。为了克服公有产权的弊端,当前主流观点是倡导推行房屋产权私有化。然而借助产权经济学和产权伦理学理论,本文分析认为,产权私有化无法兼顾旧城更新效率和弱势群体保障的双重目标,反而容易引发低收入群体利益受损、城市居住空间贫富分化等严重社会问题。在现代产权理论启示下,本文提出建立“共有产权”制度更有利于实现旧城更新中效率和公平的有机统一。按照“公私共有、社区运作、个人使用、三方获益”思路,建立符合我国实际的新型共有产权模式,将为实现小规模、渐进式“有机更新”提供坚实基础。; From the perspective of property right distribution, this paper analyzes the plight in present inner city renewal and then provides suggestions. First, with reflection of traditional state-owned prop- erty right institution, it argues that the absence of proprietor is the intrinsic inducement of large scale renewal. Therefore, the view of privatizing the state- owned houses is the mainstream. However, by refer- ring to the theories of property right economics and property right ethics, it finds that privatization can not achieve the goals of efficient renewal of inner city and social security of the unprivileged at the same time; on the contrary, it will probably result in seri- ous social problems such as benefits reduction of the lower-income and polarization of urban residentialspace. By the illumination of contemporary prop- erty right theory, it suggests that a collective-owned property right should be more propitious to realizing both economic efficiency and social fairness. Based on the principle of “public-private jointly owned, community operated, individual used, triple benefited”, the collective-owned property right will be applicable in our country’s current situation and provide vigorous foundation for small scale and stepwise renewal of inner city.
