中文摘要	数据权利建立在开放获取文化和知识产权保护。知识产权保护是创新发展战略不可或缺的一个部分。开放获取支持人们自由地、不受限制地、不受差别对待地访问知识信息，但是它的两方面限制：一是阅读性的使用不等同于机械可读技术的应用，如数据和文本挖掘，二是国家安全、商业和隐私等，正在面临多个权利所有者的挑战。数据权益是平衡利益与权利的框架，为每个利益关系人、利益团体、公众，以及促进国家开放数据政策和人民福祉而服务。
英文摘要	Data right is based on open access culture and intellectual property protection. Intellectual property protection is an integral part of innovation development strategy. Open access supports people access knowledge information freely, non- restrict and no discriminated, but its two limitation level, one is the use by reading not equal the reuse by machine-readable technology application such as text and data mining , the other are national security, commercial and privacy, is facing challenge from rights holders. Data rights is a framework that can be to balance rights and interest from each stakeholders, interest groups and public and to forward implementation of national open data policies and the welfare of the people.
